Terms of service

The agreement between Jeskie Services Ltd and every business that rents a panel from us. Please read it before you sign up: by creating a shop, you accept it.

In short

  • You run your own shop, under your own name. You are responsible for it and for what your customers order through it.
  • After a free trial of 14 days, your plan is paid in advance. Plan fees are not refunded.
  • Money your customers add is prepaid credit for your services. It is never paid back out to them.
  • Some things may not be sold at all. Everything else is sold at your own risk with the social networks.
  • We may suspend a shop that breaks these terms, and our liability is limited.

1. About these terms

These terms are an agreement between you, the business that signs up for a panel ("you", "the shop"), and Jeskie Services Ltd of Nairobi, Kenya ("Jeskie SMM Reseller Platform", "we", "us"). They cover our website, the panel software, the shop admin, our API and any payments we collect for you.

You accept them by ticking the box when you create a shop. We record the date and the version you accepted. Our privacy policy, cookie policy and refund policy are part of these terms.

2. Who can sign up

  • You must be at least 18 and able to enter into a binding contract. If you sign up for a company, you confirm that you have the authority to bind it.

  • You use the service for your business, not as a consumer.

  • The details you give us must be true and kept up to date. That includes the identity details we ask for before we collect payments for you.

  • We may refuse any signup, or review it before the shop opens.

3. What we provide

A hosted, white-label panel from which you sell social media growth services to your own customers, under your own name, prices and domain. We provide the software, hosting, updates and the support described on our website.

You are the seller. Your customers deal with you, not with us, and your shop is not a branch of ours. You must not present yourself as us, or as acting for us.

4. Your account

  • Keep your password, sign-in codes and API keys secret. You are responsible for everything done through your account, including by the staff you add.

  • If you think somebody else has used your account, tell us at once at [email protected].

  • One business may run more than one shop, but may not open extra shops to get another free trial.

5. Trial, plans and payment

  • A new shop gets a free trial of 14 days. During the trial, online payment collection, withdrawals, custom domains, the API and bulk orders are switched off, and the number of customers and orders is limited. All of these open with your first payment.

  • Plans and their prices are on our pricing page. A plan is paid in advance for one, three, six or twelve months, using the payment methods we offer. Prices are set in US dollars and shown in your currency at an indicative exchange rate.

  • If the trial ends without a payment, or a renewal is still unpaid 1 day after its due date, your admin is locked and your customers see a maintenance page until you pay. Nothing is deleted while a shop is locked. A trial that is still unpaid 3 days after it ends is suspended.

  • A shop that stays locked for 60 days is closed, after we have warned you by email. A shop that never took a customer is deleted at that point. A shop that has customers is kept for a further 90 days: pay for any plan inside those days and it comes back with every customer, balance and order in it, and after them it is deleted and cannot be recovered. Export anything you want to keep before then.

  • You can move to a larger plan at any time and pay the difference for the months left. A move to a smaller plan takes effect at your next renewal.

  • Plan fees are not refundable. The details are in our refund policy.

  • We may change our prices. A new price applies from your next renewal after we have told you, and never to a period you have already paid for.

6. Your supply account

Orders are placed with the supply panel you connect, using your own API key and balance. You must keep that account funded and in good standing, and its own terms apply to you. We are not responsible for its prices, delivery or refunds. If a service or a supply panel has to be withdrawn, the undelivered part of each affected order is refunded to the customer's balance.

7. Taking payments from your customers

  • By default, your customers pay you directly, into your own accounts, and we never hold that money.

  • If you ask us to collect online payments for you, we act as your collection agent. Each payment is credited to your customer's balance at once. It is added to your payout balance, less the payment provider's fee, after a hold of 7 days. You can withdraw what is available to a destination you have saved. Our commission is shown before you confirm a withdrawal and is listed on our withdrawals page.

  • Before we collect payments for you, we verify your identity. We may limit how much we collect or pay out, and we may hold a payout while we look into a payment that seems fraudulent, disputed or unlawful.

  • If a payment is reversed or charged back, the amount is taken from your payout balance. If that balance is not enough, you owe us the difference.

  • You are responsible for your own taxes, licences and records.

8. Your customers and their balances

  • Money your customers add is prepaid credit for your services. The software cannot refund it to a card or wallet, or pay it out as cash, and your customers confirm this before their first top-up. Cancelled, failed and partly delivered orders are refunded to the customer's balance automatically.

  • You must publish terms, a privacy policy, a refund policy and a cookie policy for your shop. We provide wording that you can edit. You are responsible for what your policies say, and they must not promise anything the software does not do.

  • You handle your customers' questions, complaints and disputes. We are not a party to them.

  • You are the controller of your customers' personal data, and we process it for you as our privacy policy describes. You need a lawful basis for the data you collect, and you must not use it for spam.

  • If you choose to return money to a customer outside the panel, that is between you and the customer.

  • If you connect your own Google Analytics, your shop asks its visitors for permission first, and its cookie and privacy policies list what is collected. The Analytics account is yours: you must not send anything into it that identifies a person.

9. What you may not sell or do

You may not use the service, or let your customers use it:

  • for fraud, scams, phishing, pyramid schemes or money laundering;

  • for content that is sexual, hateful, violent or illegal where you, your customer or we are based, or that targets or exploits children;

  • for unlicensed gambling, illegal drugs, weapons or other unlawful goods;

  • to impersonate a person or a brand, to post fake reviews, or to manipulate elections, public debate or financial markets;

  • to harass anybody, or to promote an account or post without its owner's permission;

  • to send spam, to break into or overload our systems, to copy our software, or to get around a limit we set;

  • with payment methods that are stolen or not yours, or by reversing payments dishonestly.

We may cancel orders that break this section, and suspend the shop that placed them.

10. The social networks

  • We are not affiliated with, endorsed by or sponsored by any social network. Their names are used only to describe what a service is for.

  • Buying followers, likes, views or other engagement may break a network's own rules. The network may remove what was delivered, limit an account's reach, or restrict or close the account. You and your customers take that risk.

  • Delivery times are estimates. Counts can drop after delivery, because networks remove accounts and activity they judge not to be genuine. Drops are not refunded. They are replaced only where a shop offers a refill for that service.

11. Suspension and closure

  • We may suspend or close a shop if it breaks these terms, attracts repeated abuse reports or payment disputes, or puts other shops or our payment accounts at risk, or if the law requires it. Where the risk is serious, we may do so without notice. Where we can, we tell you why and what would put it right.

  • A suspension does not touch your customers' balances. If we close a shop for fraud, we may hold the payouts linked to that fraud for as long as the law allows.

  • You can stop at any time by not renewing. To close your shop, write to [email protected]; we then handle your data as our privacy policy describes.

12. Your content and our software

Your shop's name, logo, texts and customer data remain yours. You allow us to host, copy and display them only to run your shop.

The software, its design and our brand remain ours. While your shop is active, you may use them to run it. You may not sell, sublicense, copy or reverse engineer them.

13. Availability and changes

We work to keep the service running, but we do not promise that it will always be available or free of errors. We may carry out maintenance, and we may change or remove features. If we remove something you pay for, we will tell you in advance.

14. Liability

  • The service is provided "as is". As far as the law allows, we make no promises beyond those in these terms.

  • We are not liable for: loss of profit, revenue, customers or reputation; indirect or consequential loss; anything a social network does; the supply panel you connect; or delays and failures caused by payment providers, networks or other events outside our control.

  • Our total liability to you for anything arising from the service is limited to the plan fees you paid us in the twelve months before the claim.

  • Nothing in these terms limits any liability that the law does not allow to be limited, such as liability for fraud.

15. Indemnity

You will cover our losses and costs from any claim against us that relates to your shop, to what you or your customers ordered through it, or to your breach of these terms or of the law.

16. Law and disputes

These terms are governed by the law of Kenya. Before going to court, write to [email protected] and give us 30 days to put things right. The courts of Nairobi have jurisdiction, although either of us may seek urgent relief anywhere.

17. Changes to these terms

We post every change on this page with a new date. We tell shops by email at least 14 days before a change applies, unless the law or a security problem requires it sooner. If you do not accept a change, you may stop before it applies. If you keep using the service after that, you accept the new terms.

18. General

  • If a part of these terms cannot be enforced, the rest still applies.

  • If we do not enforce a right straight away, we have not given it up.

  • You may not transfer this agreement without our written consent. We may transfer it to a company that takes over our service, and we will tell you if we do.

  • These terms, and the documents they link to, are the whole agreement between us about the service.
